( 127 ) June ye. 12th. 1691 - - - - - - - - - - Edmund: Beauchamp. Plt. Somerset County Ss. Bernard:Ward of this County was attached Contra. to answer unto Edmund Beauchamp of this County Clk in Bernard: Ward. Deft. an action upon the Case &c. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - And whereupon the plt by James Sangster his Attorney Comes And sayes that in Anno Dommi 1687 and Since the sd Bernard deft hath been and is Still indebted unto the plt in ye full and just Sum of five hundred thirty two pounds of tobacco being for Clerks fees due from the sd deft to ye plt, which Said Sum doth and may appear to be the just right of him the sd plt as by account thereof in Court produced but ye said deft fraudulently and Craftily intending to deceive the plt of the same hath hitherto denyed and yet doth deny payment, thought often thereunto required by the sd plt. to the sd plts great losse. & damage to the value of pounds of like tobacco & hereupon brings this Suite &c. The Deposition of Walter:Read aged abot 42 years sheweth that Walter Read being at the house of Jno: Jones when Henry: Hall came to demand of the abovesd John: Jones a Bill in his own name, and he would deliver up ye old Bill which he refused to do, saying he had a Bill in his hand allready and that he would give him no other and Henry:Hall replying that he had trusted too long to a broken Staff allready, and that he would take his Course and further Saith not. Deposition Sworn to in Open Court by the Deponent this 12th: June. 1691 |
