the district. The other four must be active
attomeys-at-law and are appointed by the Gover-
nor for three-year terms. The Governor annually
designates the chairperson of each board.
The Public Defender provides legal representa-
tion for any indigent defendant in criminal or ju-
venile proceedings requiring the presence of coun-
sel before a commissioner or judge, post-
conviction proceedings, and any other proceeding
where incarceration pursuant to a judicial com-
mitment of individuals in institutions of a public
or private nature may result.
In 1975 the Public Defender installed three
Divisions in the headquarters office, i.e.. Mental
Health, Appellate, and Inmate Services. Each Di-
vision provides services as indicated by furnishing
representation to all persons involuntarily com-
mitted to facilities under the jurisdiction of or li-
censed by the State Department of Health and
Mental Hygiene, the processing of all appeals to
the Appellate Courts, and legal assistance to all
indigent inmates who have legal problems con-
cerning their incarceration. The law applies only
to representation in or respect to the courts of
Maryland. The Public Defender must submit a
report annually to the Board of Trustees, the
Governor, and General Assembly. The Public
Defender system commenced operation on Janu-
ary 1, 1972 (Code 1957, Art. 27A).

The Public Disclosure Advisory Board, former-
ly called the Financial Disclosure Advisory
Board, was originally created by Chapter 3, Acts
of the Special Session of 1973, to oversee the law
requiring the public disclosure of the personal
finances of public officials in Maryland. In 1977
(Chapter 938), the Legislature added to the
Board's responsibilities oversight of the law re-
quiring lobbyists to register and file activity
reports.

"The Board consists of five members. One is
appointed by the Governor, two by the President
of the Senate, and two by the Speaker of the
House of Delegates. One appointee of the Presi-
dent and one of the Speaker must be from the
majority party and one each from the minority
party. Members serve four-year terms, coextensive
with the term of the Governor. The Board selects
its own chairperson and the necessary staff.
The Board has the duty to recommend to the
Secretary of State such forms as may be desir-
able for the filing of the necessary statements. It
reviews statements filed, investigates complaints
of alleged violations of the Disclosure or Lobby-
ing Acts, and reports violations to the Attorney
General. The Board issues opinions concerning
the coverage of the Acts upon the request of
persons required to file statements, and may is-
sue an opinion upon the request of any other
person.
Persons required to file the financial disclosure
statements must do so by April 15 of each year.
Persons required to register as lobbyists must do
so by January 10 or not later than 5 days after
first performing any acts requiring registration,
whichever is later. Registered lobbyists must file
two activity reports annually, one by May 31
covering the period November 1 through April
30, and one by November 30 covering the period
May 1 through October 31. Financial disclosure
statements, lobbyists' registrations, and lobbyists'
activity reports are filed with the Secretary of
State (Code 1957, Art, 33, sees. 29-1 to 29-12;
Art. 40, sees. 5 to 14A).
