ful, to and for each and every defendant in any action of debt
hereafter to be brought on any bond with a collateral condition,
in any court in this state, where the declaration of the plaintiff
does not disclose the particulars of the plaintiff's demand, to
plead by way of rejoinder, to any replication in any such case,
with the leave of the court for that purpose first had and ob-
tained, as many several matters in several rejoinders, as such
defendant or defendants, may deem necessary or expedient for
his defence, in any such case.

 

CHAPTER 222

AN additional SUPPLEMENT to the ACT* for enlarging the Powers of the
Chancery Court.

SEC.1. Be it enacted, by the General Assembly of Maryland,
That the chancellor, or any county court, setting as a court of (
equity, upon the application of the trustees of idiots, lunatics, or
any person interested, may order the sale or lease of any real or
leasehold property of such idiot or lunatic, for the payment of

debts, or for their support and maintenance ; Provided, that the
chancellor, or the county court, as the case may be, be first
satisfied that it will be for the interest of such idiots or lunatics,
that such property be sold, or leased ; And provided also, that
the proceeds of such sale of real property be considered as real
estate, and as such descend to the heirs of said idiots or lunatics.

A SUPPLEMENT to an ACT,* entitled, an Act to regulate the Inspection of
Tobacco.

63.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act, it shall and may be
lawful to break up any hogshead of tobacco, which has been
previously inspected agreeably to law, and to repack said to-
bacco in parcels of any size, and the same to export or carry out
of the state, by water, and when any such parcels of tobacco,
less than a hogshead, are to be shipped for exportation, the
captain of the vessel in which it is to be shipped, is authorized

to receive the same ; Provided, the quantity contained in said
parcels does not exceed in weight that set forth in the original
manifest of the hogshead, from which the same has been taken
and repacked.

Proviso.

SEC. 2, And be it enacted, That any captain of a vessel who
shall take into his vessel for exportation, any parcels of tobacco,
less than a hogshead, shall, when he deposites with the United
States' collector the original manifests of said tobacco make oath
that he believes said parcels to contain no greater quantity than
that set forth in the said manifests.
