LAWS OF MARYLAND.— 1828.

SEC. 2. And be it further enacted. That it shall not be law-
ful for any person or persons to stake down any seine or net
across the Patuxent river for the purpose of taking shad or
herrings.

SEC. 3. And be it enacted, That if any free person or persons
shall be guilty of any of the offences recited in this act, he shall
forfeit and pay for each and every offence the sum of twenty
dollars, to be recovered before any justice of the peace for the
state of Maryland as other small debts are recovered, one-half
to the use of the informer, the other half to the state ; and if
committed by any slave or slaves, he or they shall be taken
before some justice of the peace and be punished, in his discre-
tion, not exceeding thirty-nine lashes, unless the owner of such
slave shall pay the fine herein imposed for every offence as
aforesaid.

A SUPPLEMENT to an ACT, entitled, an Act to amend the Lottery System.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That it shall not be lawful for any person or persons within
this state, to draw or cause to be drawn, any lottery or lotteries,
or scheme of any lottery or lotteries, or other device, or game of
chance, or to notify the public of any lottery or lotteries, or
scheme of any lottery or lotteries, or other device, or game of
chance, unless such lottery or lotteries, or scheme of any lottery
or lotteries, or other device or game of chance, shall have been
first approved of in writing by the lottery commissioners, for the
time being; who are hereby required and directed not to ap-
prove of any lottery or lotteries, or scheme of any lottery or
lotteries, or other device or game of chance, other than those
which the said commissioners may and. shall propose on behalf
of this state, unless the same shall have been expressly granted
by the general assembly of Maryland, and also approved by
the governor and chancellor of this state, if so required to be
by the act or acts granting the same, and which not having
been forfeited nor fulfilled, may yet be in force and remain in
whole or in part to be satisfied.

SEC 2. And be it enacted, That any and every lottery, or
scheme of a lottery or other device or game of chance, shall be
considered, and hereby is declared to be, unauthorized and pro-
hibited by and within this state, unless the same shall have
been expressly granted by the general assembly of Maryland,
and also approved of by the lottery commissioners, as herein
before prescribed ; or unless the same shall be proposed by the
said commissioners on behalf of this state.
