commissioners' district, shall constitute the second class, and

tute the third class, and shall continue in office until the

SEC. 2. And be it enacted, That at the annual election in
October, eighteen hundred and thirty-nine, two commissioners
possessing the qualifications required in the first section of
this act, and residents of the third commissioners' district,
shall be elected by the qualified voters of Somerset county, in
the same manner as the delegates to the general assembly are by
{aw directed to be elected, and shall be certified and returned,
and the certificates and return shall be recorded, as required
in the first section of this act, to supply the places of the com-

missioners of the third class, and in like manner two commis-
sioners, as aforesaid qualified and resident in the second com-
missioners' district, shall be elected at the annual election in

SEC. 3. And be it enacted, That if any commissioner elected
as aforesaid, shall die, resign, or refuse, or neglect for twenty
days after his election, to qualify as commissioner, or shall re-
move from the county, at any time within the period for which
he shall have been elected, the remaining commissioners, who

shall have qualified according to law, shall proceed to appoint
a person possessing the qualifications required in the commis-
sioner so dying, resigning, or refusing, or neglecting to qualify,
or removing from the county aforesaid, to fill his place, and the
commissioner or commissioners so appointed, shall continue in
office until the next ensuing annual election in the said county,
