SAINT MARY'S COUNTY,

and enjoined by law, according to the best of his skill and judg-
ment, without being influenced by favour, affection, hatred,
malice, or ill-will, and that he will in making all appointments
to office, vote for such person among those willing to accept, as
in his judgment and belief shall be most capable and best quali-

fied to perform the duties of such office, which oath shall be re-
corded in a book to be kept among the records of Saint Mary's
county court.

SEC. 8. And be it enacted, That the commissioners elected
or appointed as aforesaid, and their successors shall be, and
they are hereby constituted a body politic and corporate, by
the name, style and title of the commissioners of Saint Mary's
county, and by that name shall have continued succession, and
be capable in law of suing and being sued, of making and using
a corporate seal, and of doing all such acts as shall be neces-
sary to the exercise of all powers which are or shall be vested
in them by this act, or by any other act of assembly, as fully
and effectually as corporate bodies may or can lawfully and
rightfully do.

SEC. 9. And be it enacted, That when and as soon as the
commissioners to be elected or appointed as aforesaid, shall
have taken and subscribed the oath or affirmation herein before
described, all the powers, rights and privileges, lawfully exer-
cised by, and all property, estate and effects vested in the jus-
tices of the levy court of Saint Mary's county, shall be trans-
ferred to and vested in the commissioners for Saint Mary's coun-
ty, who, or a majority of them, shall thereafter exercise all the
said powers, rights and privileges, and shall perform all the du-
ties required to be performed by the said justices of the levy
court of Saint Mary's county, and no appointment of justices of
the levy court of Saint Mary's county shall thereafter be made.

Per diem,
two dollars.

SEC. 10. And be it enacted, That each of the said commis-
sioners shall be entitled to receive two dollars per day, for
everyday he shall necessarily attend to the duties of his office.

SEC. 11. And be it enacted, That the said commissioners,
shall and may at any time during each and every year, make,
complete, and close their levy, any law to the contrary not-

withstanding; and that all suits at law, and in equity, which
may be pending at the time of the passage of this act, by or
against the justices of the levy court of said county, shall be
carried on in like manner, and have the same legal effect,
either in favour of or against the commissioners provided for
by this act, as if such suit or suits had been instituted by or
against the said commissioners.

SEC. 12. And be it enacted, That so much of any acts of
assembly, as may be contrary to, or inconsistent with the pro-
visions of this act, be, and the same are hereby repealed.
