An ACT to regulate the Appointment, and enlarge the Powers, of the
Levy Court, and to abolish the Office of Commissioners of the Tax, in
Queen Anne's County. — 1828, ch. 14.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That the office of commissioners of the tax in Queen Anne's
county is hereby abolished ; and that all the powers, duties,
property and papers, belonging to said commissioners, in their
official capacity, shall be transferred to the levy court of said
county.

SEC. 3. And be it enacted. That the said levy court shall
appoint a well qualified person, a resident of said county, who
shall not at the same time hold the office of county clerk, to
act and serve as clerk to the said levy court, and to discharge
all the duties which have heretofore severally belonged to the
clerk of the levy court and to the clerk of the commissioners
of the tax : and the person so appointed shall, previously to
his entering upon the duties of his office, execute a bond to the
state of Maryland, to be approved by the said levy court, in the
penalty of one thousand dollars, for the true and faithful perfor-
mance of the duties hereby imposed; which bond shall be re-
corded in the clerk's office of said county, an office copy of
which bond, under seal, shall be evidence in any court of law
or equity in this state; and shall subscribe the following oath,
or affirmation, as the case may be : 1, ——— ——— , do swear, or
affirm, that as clerk to the levy court of Queen Anne's county,
I will honestly and faithfully, to the best of my skill and judg-
ment, execute the duties of said office without favour, affection
or prejudice, so help me God ; which oath, or affirmation, is to
be administered by one of the judges of said court.

Books to be
delivered

SEC. 5. And be it enacted, That upon the appointment of
said clerk, the clerk of the county court in Queen Anne's
county shall deliver to the said clerk, when directed by the
said levy court, all the books, accounts and papers, belonging
and appertaining to the said levy court, and shall furnish the
said levy court with copies of such lists, accounts and papers,
as may be at any time required by said levy court, in ascertain-
ing the county charges, or for other purposes, and shall receive
for such services such fees as he is now entitled by law to re-
ceive ; and in case the said clerk shall refuse or neglect to
comply with the provisions of this act, he shall, for every such
refusal or neglect, forfeit and pay to the said levy court, for
the use of said county, one hundred dollars, to be recovered by
indictment or action in said county.
