fide subscriptions to the amount aforesaid have been
actually made, and shall transmit said affidavit to
the Governor of this State, and thereupon the Trea-
surer of this State shall be and he is hereby au-
thorized and directed in the name and on behalf
of this State to subscribe for so many shares of the
capital stock of the said company as shall amount
to the said sum of one hundred and ten thousand,
four hundred and fifty-five dollars, and the said
Treasurer shall, out of any unappropriated money
in the Treasury, as per Act of eighteen hundred
and sixty, chapter three hundred and three, pay
the instalments on each share of the said capital
stock for which lie may subscribe as aforesaid on
the warrant of the Comptroller, which the latter
officer is hereby directed to issue as the said instal-
ments may be called for agreeably to the provi- |

sions of this Act; provided, that the Treasurer,
shall not at any time pay upon the State subscrip-
tion to the capital stock of the said company a
greater amount than shall have been actually paid
by the other subscribers to the said capital stock.
Sec. 22. And be it enacted, That as soon as the
Treasurer shall have subscribed in the name and
on behalf of this State to the capital stock of the said
company as aforesaid, the State shall be entitled
to three directors in the said company to bo ap-
pointed by the board of public works, and shall be in
addition to the directors hereinbefore provided for,
and the said directors on the part of the State shall
have the same powers, rights, privileges and du-
ties as belong to other directors of the said com- |

pany; provided, that in the election of directors
on the part of the stockholders in the Queen An-
ne's and Kent County Railroad Company, the
stock of the State of Maryland shall not be voted,
nor shall the same be counted in ascertaining the
presence of a quorum necessary to such election. |

Sec. 23. And be it enacted, That the said com-
pany shall have the right to construct a line or
lines of wires of telegraph on any route over
which, by their charter, they have a right to con-
struct a railroad, and for that purpose shall been-
titled to the benefit of all the provisions contained
in the twenty-sixth Article of the Code of Public
