Preamble. |
premises to Samuel L. Baker, of Kent county, and
took his bond to the State conditioned to pay to
the heirs and persons entitled, of said Hendrix
their respective proportions of the proceeds of sale,
and returned all their proceedings to the court
which confirmed the same; and whereas, the said
Samuel E. Baker paid a portion of the purchase
money aforesaid and contracted in writing and did
sell to Doctor Samuel V. Mace, of Cecil county,
the said lands, and said Samuel V. Mace paid a
portion of the purchase money when the said
Samuel E. Baker departed this life; after which
the said Samuel V. Mace also departed this life
intestate, leaving the following persons his heirs
at law, to whom the said real estate descended,
subject to the payment of the balance of purchase
money due thereon; and which his administrator,
Thomas P. Jones, is represented as ready to pay
to the executors of the said. Samuel E. Baker,
whenever a valid deed can be given for the same;

SECTION 1. Be it enacted, That John Brown and
David H. Crane, of Queen Anne's county, or the
survivor of them, being surviving commissioners
appointed by the Circuit Court of Queen Anne's
county, on the petition of John W. Hendrix, to
divide the real estate in the said county of John
Hendrix, late of Queen Anne's county, deceased,
be and they, or the survivor of them, are hereby
authorized and empowered in conjunction with the
executors of Samuel E. Baker, late of Kent coun-
ty, to convey by deed, to be duly executed and
acknowledged according to law, the legal title to
a farm in Queen Anne's county aforesaid, contain-
ing two hundred and forty-three acres, three roods
and three perches of land more or less, formerly the
property of Mary Ann Brice, deceased, and after-
wards the property of John Hendrix, deceased,
and which was purchased by Samuel E. Baker of
the said John Brown. David H. Crane and others,
commissioners appointed by the Circuit Court of
Queen Anne's county, to divide the real estate of
said John Hendrix to William H. Mace, Carville
V. Mace, Charles R. Mace, John H. Mace, Sophia
Virginia Mace, Franklin Mace, Alford Mace and
Ann Catharine Jones, the heirs at at law, of Sam- |
