into which such consolidation and merger shall have been made
at any time within three months after the vote for the same,
he or she'shall receive from the company into which the con-
solidation and merger shall have been made the fair value of
his or her stock at the time when the vote for the agreement
of consolidation and merger was cast, which, if not agreed on,
shall be appraised by three disinterested persons, residents in
this State, to be appointed by the Secretary of State, whose
duty it shall be to make such appointment on reasonable
notice on the application of either party, and thereupon and
upon the payment of the value so ascertained, such stock-
holders shall deliver up his or her certificate of stock, if any
such has been issued, and the said company into which the
consolidation and merger have been made may re-issue the
same amount of stock to any other person or persons.

SEC. 9. And be it further enacted, That the company hereby
incorporated shall have the power to make, construct and
maintain a railroad with double or single tracks, as sidings,
as they may deem expedient for the transportation of passen-
gers, for merchandise and produce in cars propelled by elec-
tricity in any form or other improved motive power other
than steam, with the right to erect, and maintain such poles,
wires and appurtenances as may be necessary for the exercise
of any of the rights, powers, privileges or franchises hereby
granted; and to build the necessary switches to its car barns
and power-houses, and also to build the necessary turnouts
and connections in the City of Annapolis, Anne Arundel
County, Prince George's County, and such other counties in
the State of Maryland into which said railway company's
main line or branches may project, in pursuance of the pro-
visions hereof.

SEC. 10. And be it further enacted, That any and all rights,
powers, privileges or franchises whatsoever which may
hereafter be granted or extended to the said railway company
by any county, municipality or the proper officers thereof
shall be as effectual and binding upon the said counties or
municipalities so granting the same, as if said grant of powers,
rights, privileges or franchises had been expressly ratified
and confirmed by Act or Acts of the General Assembly of
Maryland subsequent to the granting thereof.

SEC. 11 . And be it further enacted, That the said company be
and it is hereby authorized in "order to construct said railway
and to enjoy the other rights, powers, privileges and fran-
chises hereby granted, to acquire the land or property of any
