John Ellis Sen^r: def^t: of Trespass on the Case &^t:
And Whereupon the pl^t: by his attourney Thomas Poole Comes and Sayth that
he the said John Standeth indebted unto the pl^t: the full and just Sume of Twelve
hundred pounds of Toba^o: as pr accompt here in Court prduced the which Accompt he the
Said John did agree with the pl^t: and faithfully prmiss to pay unto the pl^t: when there
unto required by the pl^t: but he the said John fraudulently Intending the pl^t: to deceive
of the Sume afores^d: doth denye and still doth denye to pay the same although often
Thereunto required by the pl^t: Whereupon the pl^t: Sayth he is damnified & hath
Damage to the Vallew of Sixteen hundred pounds of Tobaccoe and thereupon brings
This Suite &^t:

To the Rent of a plantacon in Morumscoe for 3 yeares at 400^lb: of Tob^o: pr yeare . . 1200
And the said John Ellis Sen^r: by his attourney John Taylor Cometh and defendeth the
force and injury when &^t: and prayeth Liberty to imparle hereunto Untill the Next County
Court and it is granted him the same day is granted to the pl^t: alsoe
At which Said County Court Viz^t: the 13^th: day of June in the xiiii^th: yeare of the
Domion of the R^t: hono^ble: Charles &^t: annog Domi 1689 Came the said Thomas Poole
attourney to the pl^t: as alsoe Came the Def^t: by his attourney likewise who sayth that
The pl^t: his accon he ought not to have for that the def^t: sayth he bought and paid
The Land to the pl^t: and for Rent he owes None and this he prayes may be Enquired
by the Countrey and the pl^t: alsoe -
Upon which Comand was given to the sheriff of this County to Cause to Come here Twelve good
and Lawfull Men of his Bayliwick by whome the truth of the Matter might be the
better knowne and who Neither &^t: to recognize &^t: because as well &^t: . . . . .
Now here at this day to witt the 13^th: day of June as afores^d: Came the said parties by
