Sommersett Ss John Tyler was summoned to answr unto wm Stevens gentl in a plea of Debt &c
And Whereupon the Said William by his Attourney Henry Smith Saith that he the Said John became
Indebted unto him the Said William the full & Just summe or quantity of seaventeene hundred
forty & nine pounds of good Sound Marchantable bright and Lardge tobacco and Caske as pr A
Certaine writing here in Cort: produced more plainely will appeare bearing date ye 28th day
of June Annoq Dom: 1675 Signed with ye hand and Sealed with ye Seale of him the Said John
wherein ye Said John Did assume upon himselfe and promise to pay or Cause to be paid to ye Said
William his executors admrs or assignes the said quantity of 1749lb: of Tobacco & for the true performance
whereof he the Said John bindes himselfe his heires executors & admrs but he the Said John Little regarding
his promise and assumpcon fraudulently intending to deceive him the Said William of the said 1749lb of
Tobacco & Caske denyeth & Still doth to pay the Same although often thereunto required the plte Saith he is
Damnified & hath Damadge to ye vallue of 2900lb of like tobacco & Caske & thereupon brings his Sute ~ ~
This bill bindeth me John Tyler of Somrsett County in ye province of Maryland Carpenter my heires
executors & admrs to pay or Cause to be paid unto William Stevens of ye Same County & Province his executrs
admrs or assignes the quantity of seaventeene hundred & forty nine pounds of good Sound Marchantable
bright & large tobacco & Caske it being due for valuable Consideracon already in hand recd: as witness by hand
& Seale this 28th day of June Ao 1675 ~ ~ ~ ~ ~ ~ ~ John Tyler (Seale)
