10 Sommersett Ss: William Giles Late of this County was summoned
to Answer unto Randall Revell of the same County
in A plea of Debt &c ; ~ ~ ~ ~ ~
And whereupon the said Randall by his Attourney Henry Smith
saith That he the said William became Indebted unto him the
said Randall the Just summe or quantity of five hundred
thirty nine pounds of good sound marchantable tobacco & Caske
as by A Certaine specialty will appeare (here in Cort: produced)
Signed with the hand & Sealed with the Seale of him the said
William bearing Date the seaventeenth Day of november
Intrat agt: Janr: Annoq Domini 1673 wherein the said William Did assume
Cort: 1674 upon himselfe and promise to pay unto y Sd: Randall his
executors: admrs: or Lawfull Attourney the Sd: quantity of 539lb:
of good sound marchantable tobacco & Caske upon demand And
for the performance whereof he the said William bindes himselfe
his heires executors: & admrs: But he the said William Little
regarding his promise & Assumpcon fraudulently intending
to Deceive him the said Randall of y sd: 539lb: of tob: & Caske
denyeth & Still doth to pay the same Allthough often thereunto
(required) The plt: saith he is Damnified and hath Dammadge
(to the vallue of one) Thousand pounds of tob: & thereupon brings
