John Hillard deft: may be read saying that the deft: hath absented himselfe
In an Accon upon from Justice the writt being returned by the sherriffe
the Case n: est Invts: ~ ~ ~ ~ ~ ~ ~
The Complaint of James Cerill against John
Hilliard in an accon upon the Case ----------
Humbly sheweth
That one George Eaves deceased became indebted unto the above
said Cerill the summe of one thousand pounds of good Sound
marchantable tobacco in Caske as by his Obligacon under his hand
and Seale doth more at Large appeare bearing date the 30th: day
of october 1671 which tobacco was to be paid upon demand
at the dwelling house of John Rennys where the abovesaid
Cerill keepes his Store, The abovesaid Hilliard did promise
to pay the abovesaid some according to the said George Eaves
his Obligacon unto the abovesaid Cerill as well before the
Death of the said George Eaves as alsoe Sence which your
Complainant Can here prove in open Courte, notwithstanding
the said Hilliard hath disposed of the estate of the abovesaid
George Eaves Contrary to Law he the said Hilliard not haveing
the deceased last will and testament nor hath taken out noe
Letters of administracon only to Defraude the Creditors of
the deceased; The abovesaid Cerill haveing Demanded the
abovesaid summe of the abovesaid Hilliard in honnor to
his word and good Contience he the said Hilliard doth refuse
to pay the same to the Complaynants Dammadge five hundred
pounds of the like tobacco all which Debt and Damage the said
Cerill Craves Judgemt: of the Courte with Cost of Sute ~ ~
