50 The Same Day Commrs: as afore
Edmund Beauchamp plt:
vers in A plea of Debt
John Ellis Deft:
The plt: and deft: being Called appeare before the board
John Ellis Late of Sommersett County was attached to answer
Edmund Beauchamp in A plea of Debt &c
And whereupon the said Edmund Beauchamp for himselfe saith
That he the said John Ellis Did upon the 18th: day of Aprill in
the XXXiXth: year of the Dominion of Caecilius Annoq Domini 1671
by A Certaine Specialty signed with the hand and Sealed with y Seale
of him the said John Ellis which is produced by the plaintiffe here
in Cort: Assume upon himselfe and promise to pay unto Edmund
Beauchamp or his ordr: at the plantacon of mr: Wm: Stevens at or
before the 10th: day of Decembr next ensueing the Date of the said
speciallty one hundred pounds of neate porke for the performance
of which he the said Ellis bindes himselfe his heires executors: and
administrators: And afterwards upon Consideracon of halfe A dayes
of worke Due from the said Ellis to the said Beauchamp the said
Beauchamp giving him or forbearing the said halfe Dayes worke the
which the said Beauchamp did the said Ellis Did ffurther engage and
promise to bringe the said one hundred pounds of neate porke to the now
dwelling house of the said Beauchamp but the said Ellis little regarding
his Assumption and promise but fraudulently intending to deceive
him the said Beauchamp of the Aforesaid quantity of pork which
being Demanded but he the said Ellis Denieing and Still doth to pay
and bring the same The plaintiffe saith he is Dampnified and
hath Dammadge and there upon brings his Sute &c
