44 The Same Day Commrs: as afore
George Hoell plt:
vers in an Accon of the Case
William Broadwell deft:
The plt: and deft: appeare in Cort:
William Broadwell late of Sommersett County was attached
to answer George Hoell in an Accon of the Case &c.
And whereupon the said George Hoell for himselfe saith
That he the said William Broadwell Did upon the seaventh
day of October in the XXXXth: year of the Dominion of the Rt: honble:
Caecilius &c Annoq Domini 1671 by A Certaine specially
Signed with the hand & sealed with the Seale of him the said
William Broadwell which is produced by the plaintiffe here
in Cort: assume upon himselfe and promise that he the said
Broadwell woulld pay or Cause to be paid unto George Hoell
his heires executors: or assignes or to his true & Lawfull Attorney
the full and Just quantity of three hundred & sixty pounds
of good sound marchantable tobacco and Caske to Containe
the same in to be pd: unto the said George Hoell or his
aforesaid ordr: at or upon the tenth day of october november next ensueing
the Date of the said Speciallty in some Convenient place in
Somersett County to the performance of which he the said Wm:
Broadwell bindes himselfe his heires executors: and administrators:
but he the said William Broadwell Little Regarding his
promise but fraudulently intending to deceive him the said
George Hoell of the aforesaid quantity of three hundred
& sixty pounds of tobacco which being often demanded
