Richard Brittaine plt: in A plea of Trespas The plt: and deft: appeare
vers upon the Case The plt: desires his decla:

William Walstonne late of this County was attached
to answer Richard Brittaine in a plea of
Trespas upon the Case &c ; / ;
And whereupon the said Richard Brittaine for himselfe
saith That he the said William Walstonne Saith Did in the
month of March last past in the XXXXth: year of the Dominion
of the Rt: honble: Caecilius &c Annoq Domini one thousand
six hundred seaventy & one Borrowe one hhd: of tobacco of
the said Richard Brittaine And Did for the same Assume upon
himselfe and promise to pass his speciallty to the said Richd:
Brittaine for the payment thereof this next ensueing Crop but
he the sd: William Little regarding his promise but fraudulently
intending to deceive him the said Richard of the aforesaid hhd:
of tobacco having denyed & Still doth to pass his specialty for
the paymt: of the Same the next Crop; whereupon the plt:
saith he is Dampnified And thereupon brings his Sute Craving
ordr: for the paymt: of the sd: hhd: of tobacco this next ensueing

The Deft: desires that he might prove that he recd:

The plt: saith there were writts out for his evidences
but were not Served, And Craves a refference
