568 MARYLAND COURT OF APPEALS

3 That Sometime after the Complainant had Commenced his action
at Law agt the Defendt Brewerton the Complt and Thos Dashiel the Sherriff
of Somerset County Came to the Deponent and persuaded the Deponent and
Saml Alexander to go with them in the Night to the Defendant Brewer tons
and that as they were going to the Said Brewertons they met the Defendt
Adams who Stopt the Said Dashiel to talk with him and the rest of the Com-
pany rode on but that the Sd Dashiel Soon overtook them and desired the
Complt and Saml Alexander to ride on to the Said Brewertons as fast as they
Could for he was afraid the deft Adams would give the Deft Brewerton No-
tice that he was going there before he the Sd Dashiel could get there himself
This Deponent further Sayth that the Said Complt and Samuel Alexander
and Samuel Alexander [sic] did ride on and that the Said Dashiel and the
Deponent followed they and that when they the Said Dashiel and the De-
ponent got to Brewertons they found the Same horse which the Deft Adams
had with him when they left him tyed to the fence and Soon afterwards the
Said Adams came up on foot and told the Deponent that he came to his
Plantation and found the Doors of the hinges and was Come over there to
See if any of the people had lived at his Sd Plantation were there and that he
had left his horse under a peache tree tyed altho the Sd Horse then Stood
tyed by the Depont the Depont further Saith that he hath often before the
Action brought by the Complt agt the Deft Brewerton heard the Said Brewer-
ton Say that the Complt was to have part of his Land next to Cronches
Plantation and further Saith not

Jos Pemberton, Levin Gale, Jno Handy

[762] Isaac Noble of Stepney Parish in Somersett County Aged about 43
years being Sworne and Examined on the Part of the Complaint Saith as fol-
lows Vizt

1 That he well knows the parties the Complainant and the Deft.

2 That in the year 1718 the Deft Brewerton was indebted to the Com-
plainant in about Seven Thousand Pounds of Tobo wch this Depont beleives
was for Tobo wch the Complt had paid for the Sd Brewerton for that this De-
pon1 hath Carried Severall Notes between them This Depont further Saith
That Tobo was at the Time of the Debts becoming Due to the Complt worth
Twenty or Twenty five Shill Per hundred and that he beleives that the Deft
Adams Purchasing a part of Brewertons Land was the reason that the Deft
Brewerton Did not Satisfie the Complt before he Sued him for it and fur-
ther Saith not.

Diana Brewerton of Stepney Parish in Somersett County Aged about
36 years Sworn and Examined on part of the Complt Saith as follows Vizt

1 That She well knows the parties the Comp" and the Deft.

2 That the Deft Brewerton in the year 1718 when Tobo was worth
Twenty or Twenty five Shill Per hundred became indebted to the Complt
