MANUMISSION of SLAVES.

Jury, be called before the County Court.  And if it
appear that such Owner did not provide necessary Food
and Cloathing, or did suffer them to depart and wander
contrary to this Act, such Court shall cause such Owners
to enter into Recognizance to his Lordship, in the
Penalty of 4 l. Currency, to the Use of the County,
to provide sufficient Food, &c. for such Slaves during
this Act, and not suffer them to depart and wander
contrary thereto.  But the Running away and absconding
of Slaves, shall not be construed a Departing,
&c. within the Meaning of this Act.  Ibid.  §. 4.
    4.  Persons desirous to set Free any Slave, may, by
Writing under Hand and Seal, evidenced by two sufficient
Witnesses at least, grant such Freedom.  Which
Deed shall be good, so as the same be not in Prejudice 
of Creditors; and that such Slave, at the Time such
Freedom shall take Place, be not above 50 Years of
Age, and able to gain a sufficient Livelihood by Work.
The Deed to be acknowledged before one County Magistrate,
who shall indorse the Time of Acknowledgment,

&c. in the Back of the Instrument; which
shall be entered upon the County Records within Six
Months after Date, and the Enrollment endorsed on
the Instrument, under the Clerk's Hand.  And an attested
Copy of such Record, under Seal of the Office,
shall be sufficient Evidence of such Freedom.  Ibid.
§. 5 and 6.
    5.  The County Courts shall give this Act in Charge
to the Grand Jury at March Court, yearly, to enquire
into any Breaches thereof.  Ibid.  §. 7.

MARRIAGE.

    1.  No Minister, Priest or Magistrate, shall join any
Persons together in Marriage, contrary to the Table
of Marriages, under Penalty of 5000 lb Tobacco.
And the Persons so intermarrying incur the like Penalty
of 5000 lb Tobacco, to the King, &c.  1702,
ch. 1, §. 4.
    2.  No Magistrate, being a Lay-man, shall join any
Persons in Marriage, in any Parish wherein any Minister
or Incumbent shall reside, having Charge of
Souls therein, on Penalty of 5000 lb Tobacco, to the 
King, &c.  Ibid.  §. 5.
    3.  The Marriage Fee to be 5 s. Sterling; provided
the Parties come to Church to be Married at the Time
of Divine Service.  Ibid.
    4.  All Persons, desiring Marriage, shall apply to a
Minister for contracting thereof, and cause due Publication
to be made, according to the Rubric of the
Church of England, at some Church or Chapel belonging
to the Parish wherein the Woman is resident.

    5.  If there be no Minister or Reader in the Parish,
an Advertisement of such intended Marriage, shall be
set up at the County Court-house Door, to remain/

there Three Weeks:  Of which the County Clerk
shall make Certificate under his Hand, and the County
Seal.  After which Publication and Certificate, any
Minister duly qualified, may Marry the Persons so
published, according to the Liturgy of the Church of
England.  Saving to the Minister of the Parish his just
Dues.  Ibid.
    6.  Persons contracting Marriage without such Publication
and Certificate, or without Licence from the
Governor, shall forfeit 5000 lb Tobacco.  Ibid.  §. 2.
    7.  Every Minister joining such Persons in Marriage,
without Publication or Licence; or any ways infringing
this Act; shall forfeit 5000 lb Tobacco.  Ibid.
    8.  One Half of which Fines to the Support of Government,
the other Half to the Informer.  Ibid.
    9.  Any Persons resident in this Province, who shall
get their Marriage solemnized in any neighbouring Colony,
(unless the Woman be resident in such Colony)

MARRIAGE.

shall forfeit 5000 lb Tobacco, to the Use aforesaid.

    10.  The Minister's Fee for a Marriage by Licence,
where the Parties are married in the Parish Church or
Chapel, or come to the Minister's House, shall be Ten 
Shillings.  And in Case of Publication, where the
Parties come to be married at the Minister's Dwelling
House, 100 lb Tobacco, or Six Shillings and Eight Pence
Current Money, ready Pay.  The Fee for Publication 
is included in the Marriage Fee.  Ibid.  §. 4.
    11.  This Act shall not extend to Persons of Persuasions
in Religion different from the Church of England,
but the Manner of their Proceedings in Marriage,
shall remain unaltered, &c.  Ibid.  §. 5.
    12.  No Minister, Pastor or Magistrate, shall, upon
any Pretence join in Marriage any Negro whatsoever,
or Mulatto Slave, with any White Person, on Penalty
of 5000 lb Tobacco; one Half to the Use of Free-Schools,
the other Half to the Informer.  1715, ch. 
44, §. 25.
    13.   Any Free Negro or Mulatto, intermarrying
with any White Person, shall become a Slave for Life
(excepting Mulattoes born of White Women, who
for such intermarrying shall only become Servants for
Seven Years):  And any White Man or Woman intermarrying
with any Negro or Mulatto, shall become
a Servant for Seven Years:  To be disposed of at the
Discretion of the County Court, and applied towards
the Support of the County School.  1717, ch. 13, §. 5.

MASTERS of SHIPS.

    1.  ----Shall give Bond in 3000 lb Tobacco, within
Ten Days after their Arrival, for their complying
with the Laws of this Province, during their Stay
therein.  1661, ch. 7, §. 2.
    2.  ----Presuming to strike, or otherwise punish any
Inhabitant, on board their Vessels, contrary to his
Lordship's Peace, shall forfeit 4000 lb Tobacco; Half
to his Lordship, and Half to the Party grieved.  Ibid.
§. 3.
    3.  ----Shall not be suffered to Enter their Vessels
(if above 18 Foot Keel) or obtain a Permit to Trade
within this Province, before they have made oath, &c.
before the Naval Officer, That they will not conceal,
&c. any Servant or Slave belonging to any Inhabitants,
on board their Vessels during their Stay; not wittingly,
&c. carry any Servant, Slave, or Person Indebted,
out of this Province; common Sailors excepted.  1753,

ch. 9, §. 2.
    4.  In Case of the Master's Sickness, &c. the Chief
Mate, &c. may Enter the Vessel; but the Master
before Clearing, shall take the Oath, &c. aforesaid.

    5.  Masters or Commanders, suffering any Servants
or Slaves to frequent their Ships or Vessels, or keeping
or concealing them on board, shall forfeit and pay
to the Owner of such Servant, &c. Twenty Shillings
Current Money, for every Hour such Servant or Slave
shall be suffered to frequent, or be kept or concealed
on board such Ship, &c.  To be recovered in a summary
Way, with Costs, before a single Magistrate.  But
Masters of Ships may hire any Servants, &c. from their
Owners, to Work on Board.  Ibid.  §. 3 and 4.
