INSPECTORS.

meet at their respective Parish Churches annually, between
the 1st and 10th of September, to nominate and

recommend to the Governor, &c. for the Time being,
Four, or Two able and sufficient Planters, well skilled 
in Tobacco, for each Inspection within their different
Parishes, as the Case may require, without having
Regard to the Residence of such Persons for Inspectors.
And where Two Warehouses, under one Inspection,
shall happen to be in different Parishes, the
Vestry, &c. of each Parish shall nominate Two or
One sufficient Planter, as the Case may require, for
such Inspection.  Ibid. §. 39(Excepting, that the 
Vestry of Q. Caroline Parish, in Anne-Arundel County,
are impowered to elect and recommend Inspectors for
the Warehouse at Elk-Ridge Landing, though situate
in the Parish of St. Margaret's Westminster, the Vestry
of which Parish shall no ways interfere in the Election,
&c. of Inspectors for the said Warehouse.
Ibid.  §. 38.  And, that the Vestry of St. James's Parish,
in Anne-Arundel County, are impowered to nominate
and recommend Four able Planters for Inspectors
at the Warehouses at Watkins's-Creek and Pig-Point,
notwithstanding the former is situate in All-hallows Parish.
Ibid.  §. 123.)  But no Vestry-man or Church-warden,
being himself an Inspector, shall have Vote
in the Nomination of any other Inspector.  Ibid.  §. 48.
    4.  Every Vestry-man and Church-warden, before
they proceed to the Nomination, &c. of any Inspector,
shall take an Oath, faithfully, honestly and justly,
to nominate, &c. such as in their Judgment and
Conscience they think to be fit and capable to execute
the Office of an Inspector.  Ibid.  §. 49.
    5.  Every Vestry-man or Church-warden neglecting
or refusing (unless prevented by Sickness, &c.) to meet,
according to this Act, to nominate, &c. Inspectors;
or who, being so met, shall refuse, &c. to nominate,
&c. whereby Inspectors shall not be nominated, &c.
in pursuance of this Act, shall forfeit 800 lb Tobacco
with Costs:  One Half to the Informer, the other to

the Uses in this Act mentioned.  Ibid.  §. 47.
    6.  Vestries shall forthwith transmit Certificates of
such Nomination, &c. to the Clerk of the Council,
out of which the Governor or Commander in Chief
shall appoint, by Warrant under his Hand, Two out
of the Four, or One out of the Two Persons so recommended
by any one Vestry, to be Inspectors, &c.
And, where Two Warehouses, under one Inspection,

shall be in different Parishes, then shall the Governor
appoint One out of each Nomination to be Inspector.

    7.  Persons so appointed by the Governor, refusing to
serve, shall signify such their Refusal in Writing, under
their Hands, directed tot he Clerk of the Council,
and deliver the same to the Sheriff of the County,
within Ten Days from their Receipt of the Warrant,
under Penalty of 400 lb Tobacco, to be recovered before

a single Magistrate.  And the Sheriff shall forward
the same in like Manner as Public Letters are to be
forwarded.  And Persons again re-chosen by any of 
the Vestries to serve as Inspectors for the following
Year, shall signify their Acceptance thereof within Ten
Days of their being so re-chosen in the same Manner
as above directed.  Ibid.  §. 42, 43.
    8.  Inspectors accepting the Office, shall not resign
the same, or refuse to act therein, until the 1st of November
yearly.  Ibid.  §. 42.
    9.  Any Person so nominated or commissioned to be
an Inspector, who shall take or receive any Reward or
Gratuity to the Intent that he shall refuse to act under
such Nomination, &c. shall forfeit double the Value 

of the Money or other Things so taken, &c. to be recovered
by Indictment or Information in the County
Court, and applied towards the defraying of the Charge 
of Inspection in the County.  And the Person paying
or offering to pay, &c. any Money, &c. to the Intent
aforesaid, shall forfeit double the Value thereof, to be
recovered and applied as aforesaid, and for ever be disabled

to be an Inspector within this Province.  Ibid.
§. 44.
    10.  On the Death, Refusal or Removal of any Inspector,
the Governor may appoint any other person
mentioned in the last Recommendation for that Inspection,
to succeed him.  But, if, by Deaths, &c. there
should not be Persons enough left in such Nomination,
then the Vestry shall meet and elect Four or Two,
as the Case shall require, and transmit Certificates
thereof as before directed, out of which the Governor
shall appoint, &c.  Ibid.  §. 45.
    11.  Though the several Vestries are to elect Inspectors

annually, yet where they elect again a former Inspector,
and nominate and recommend him to be an
Inspector for the ensuing Year, such Nomination and
Recommendation shall be a sufficient Power to such
Inspector to continue in the said Office, without any
new or further Appointment of the Governor, and so
from Year to Year as long as he shall be nominated,
&c.  Ibid.  §. 46 and 48.
    12.  Every Inspector, annually, before entering upon
Duty, shall give Bond, with good Surety to his
Lordship, before Two Magistrates of the County, in
the Penalty of 48,000 lb Tobacco, with Condition,
for the true and faithful Performance of his Duty, and
also take an Oath &c. of Office (for which see the Act)
before any One Justice of the Peace for the County;
which Oath, &c. shall be certified by such Justice to

the Vestry of the Parish, and entered in the Parish Register-Book;
on Penalty (for presuming to execute his
Office before such Bond given, such Oath of Office
taken, and also the taking and subscribing the Oaths to
the Government, &c.) of 80,000 lb Tobacco.  Ibid.
§. 9.
    13.  Inspectors shall attend Duty at their respective
Warehouses from the First November to the First April,
as often as required; and constantly from the First April
to the last July yearly, (except Sundays, and the
Holidays at Christmas, Easter and Whitsuntide, or when
hindered by Sickness, or in such Cases as in this Act is
otherwise provided) and afterwards they, or One of
them, shall constantly attend at the same (Sundays excepted)
till all the Tobacco there remaining on the last

of July, shall be delivered out for Exportation; on Penalty
of 60 lb Tobacco for every Neglect, to the Party
grieved; or be liable to such Party's Action for all
Damages sustained by such Neglect, with Costs, at

the Election of such Party.  Ibid.  §. 10.  N.B.  For
particular Exceptions to the general Attendance required above,
for the List of Warehouses,
Art. 2, above.
    14.  In case of Sickness or other Disability of one
Inspector, the other may execute all the Powers which 
they jointly moght do by virtue of this Act.  But the
Inspector, so acting alone, shall be answerable for all
Tobaccoes by him so inspected and passed, and his
Bond may be sued for any Breach of the Condition by
him committed during the Absence of such sick or disabled
Inspector.  Ibid.  §. 11.
    15.  If both Inspectors at any House shall happen to
be Sick, &c. at the same Time, then, and in such Case
only, may each of them appointed a sufficient Planter to
act in his Stead, who, upon taking the Oaths of Office,
&c. (see Art.12,) shall be impowered to inspect,
&c. the Tobacco brought to the said House during
such Sickness or Disability.  But the said Sick or Disabled
Inspectors, and their Sureties, shall be answerable 
for the said Tobacco so inspected and passed, as
if themselves had personally officiated.  Ibid.  §. 12.
    16.  If a single Inspector be sick, &c. he may nominate
One sufficient Planter, who, on taking the aforesaid
Oaths, &c. may act in his Stead; but such sick

Inspector and his Sureties shall be answerable, &c.

    17.  If any Inspector feign Sickness, so as under such
Pretence to absent himself from Duty, he shall for
every Day of Absence, forfeit 320 lb Tobacco;
to be recovered before a single Magistrate, as in case of
