Comand was given to the Sheriffe of Charles
County, that by good & lawfull men of his baily-
wick he make known unto ffrancis Wyne that
he be & appeare here the fourth day of March

in the fourth yeare of the Dominion of Charles Lord Baltemore &c
Annoq Doni 1678. to shew cause if Any he have why Execution
should not issue forth upon a judgemt obtained against him by
James Thompson the fourteenth day of April Annoq Doni 1676
for Seven hundred Sixty five pounds of tobacco damages And also
nine hundred ninety two pounds of tobacco costs of suite, for which
satisfaction remaineth to be made Which said fourth day of March
on which the said Court ought to haue bin held was by his Lordpps
writt of Adjournmt Adjourned untill the fifth day of the same month
And from the said fifth day of March was by his Lordpps Writt of
Adjournmt further Adjourned untill the sixth day of March then
next following On which sixth day of March the same Sheriffe
made returne of the writt aforesaid that he had Sumoned the said
ffrancis Wyne
Afterwards to witt the tenth day of March in the yeare afore-
said cometh as well the said James Thompson by Robert Ridgely
his Attorney as the said ffrancis Wyne by Henry Bonner his At-
torney And the said ffrancis by his said Attorney saith that the
aforesaid James Thompson ought not to haue Execucon against
him the said ffrancis of the damages & costs aforesaid because he
saith that long before the issueing out of the said writt of Scire
facias to witt the tenth day of June One thousand Six hundred
Seventy six a certaine writt of Capias ad satis faciendum was issued
forth of the Secretaries Office of this Province under the scale of
the same Office attested by the Honble Jesse Wharton Esqr Deputy
Lievten* & chiefe Judge directed to the Honble Benjamin Rozer Esqr
late Sheriffe of Charles County comanding him to take the said
ffrancis Wyne if he should be found in his bailywick & him safely
keep so that he haue his body before the Justices of the Provinciall
Court the twenty Eighth day of Novembr next following to Satisfie
