            Charles County Court Proceedings, 1666—1668.     133

      Johnson because the said Daniel denied he gave him anie order to Liber C
      receave the tobaccoe, the said Bisse presentlie Replied tht he would
      indemnifie him the said Baker as to anie Dammage tht should acrue
      to him about the said tobaccoe And the Deponent Likewise further
      saith That the said Bisse Coming afterwards to Mr Bakers to receave
      the said tobaccoe and Carrie it away the said Baker forewarned him
      from doing the same, but Notwithstanding the same he Saith That [p. 270]
      thc said Bisse did beare away the said tobaccoe secretlie in th Night
      time, And this Deponent further saith not.

       Know all Men by these Presents That I Verlinda Burdit of
      Charles Countie in the Province of Marieland Sole Administratrix
      of all the Personall Estate of my deare husband Mr Thomas Burdit
      Deceased for and in Consideracon of naturall Affection that I
      beare to my Deare Children Elizabeth Burdit, Francis Burdit,
      Parthenia Burdit, and Sarah Burdit Have before the Marriage
      intended to be Consummated between me and Mr Richard Boughton
      Given and Graunted, and doe by these Presents give and graunt unto
      my Beloved Brethren Mr Samuel Eaton and Mr Nathaniel Eaton in
      trust and for the use and behoofe of my said Children Elizabeth,
      Francis Parthenia, and Sarah all my Right title, and interest in
      tht part of my said Husbands personall estate as herein followeth
      That is to Say I Give unto my said Trustees for my said Children
      foure Cowes going by the Names of Tibb, Buck Gallant, and Starre
      Likewise I give unto them foure two yeare old Heifers known by
      the Names of Rose, Sweet-lips Primrose, and True Love and allsoe
      foure yeareling heifers Marked wth the Proper Markes Recorded for
      Cattle belonging to my said Children; Allsoe I give and graunt to
      my said Trustees for the use of my said Children as aforesaid three
      Mares known by the Names of Tibb, Doll and Joane To Have
      and to Hold the said Cowes Heifers and Mares before mentioned
      together wth all and everie their increase male and female from
      the time of the Date of these Presents joyntlie and Severallie for
      the use and behoofe aforesaid to them my said Trustees and their
      assignes in Manner as followeth That is to Say That my Intent
      and Meaning is That my said Trustees shall Deliver an equall
      portion or fourth part of the said personall estate hereby Setled,
      to either or anie of my said Children Elizabeth Francis, Parthenia
      and Sarah soe soon as anie or either of them Shall come to full
      age or shall enter into the estate of Marriage And Further I doe
      Covenant graunt and agree to and with my said Trustees That the
      said Cowes, heifers, and Mares shall during the Nonage or Maiden-
      head of my said Children be Remaining upon tht tract and parcell
      of Land Descended to them from my said Deare Husband and [p. 271]
      their Father Mr Thomas Burdit Deceased aforesaid Containing one
      Thousand acres and Called Part of it Burdits Rest and other part
      Burdits neast And Likewise That they shall have power to make
