[Council to Colo Philip Thomas]

It being impossible for us to judge of the Truth of the Facts set
forth in the enclosed Petition, we request you will, after giving the
Parties concerned due Notice, make Enquiry into them, and report
to us whether they be well founded. If you find it necessary to take
any Depositions on the Occasion, you will be pleased to transmit them
to us also. Major Bailey having the Command of the Guard, and
being responsible for the Conduct as well as Security of the Prison-
ers, ought undoubtedly to be allowed to make such proper internal
Regulations as have been usual in like Cases; but we would by no
Means countenance such as unnecessarily bear hard upon any of
the Inhabitants, especially those who are most liable to suffer from
the Prisoners. We are willing to believe that the Fact respecting
the Confinement of People, for complaining to the Officer of the
Guard &ca is greatly exaggerated, or entirely misrepresented; as we
know of no situation or Circumstance which could justify such Con-
duct in an Officer. If it is absolutely necessary to erect an Hospital

immediately, and it can be done at little Expence, the Public Timber
at Frederick may be put to that Use; though if this Building can be
delayed without Prejudice, 'til you can apply to the Minister of the
War Department for his Approbation (as the Expence will be Con-
tinental) we should prefer it. Should it not be necessary to erect
an Hospital, you will dispose of the Timber on the best Terms in
your Power. Abraham Miller of your County has petitioned to be
relieved from a Fine imposed on him by a Court Martial; as the Pro-
ceedings of the Court have not been transmitted we cannot take his
Case into Consideration. You will therefore be pleased to transmit
them by the first Opportunity.

We are favored with yours of the 12th Instt and are greatly obliged
by the Information it contains. The first Moment we had any cer-
tain Accounts of the Enemy's Depredations, we took Measures to
put the Barges in Motion and we expected three of them would have
been in Readiness by this Time, to proceed against the Enemy, but
are disappointed; however we flatter ourselves that by Tuesday or
Wednesday next, we shall be able to afford effectual Security, against
the present Force in the Bay, to all above the Month nf Potowmack

Saturday 16th March 1782

Ordered that the western shore Treasurer pay to Capt Philemon
Warfield, seven pounds four shillings and eleven pence of the Bills
emitted under the Act for the Emission of Bills of Credit &ca due him
in lieu of an Order on the Treasurer of the 11 of May 1781 in his
favor for twenty pounds, fourteen Shillings as adjusted and passed. —
