dered me Incapable of giving my usuall & Constant Attend-
ance in the uper house for the necessary dispatch of business
in the time of the Assembly And by Consequence from hearing
the Debates in the uper house And Considering yor messages
upon that Bill so shall take the Liberty to make use of their
Lordships Arguments why that part of the Act shou'd be
Altered & the mony ariseing thereby made payable to his
Ldship the Lord Propry and not to the Leivt Govr for the time
being this being the only Exception to that Act. The Lord
Propry by his Charter from the Crown being hereditary Gov-
ernour of Maryland And all Rights of Government do un-
doubtedly belong to his Lordship And therefore his Lordship

cannot Consent with Honr that what is Raised for the Support
of his Governmt shou'd be made payable to any person who
Acts by Deputation under his Lordship. These reasons Carry
in themselves such Weight as I hope there will be no Occasion
to Offer any more to Induce you to Alter that Act in the man-
ner proposed.
As for my part who have the Honour to represent his
Lordship in this Province I must acknowledge there is so
generous a support made for the dignity of my Station that
his Lordship's Liberality has left no room to desire any new
favours from the Country tho' I am very thankful to you for
what has been already Conferr'd on me which I fully enjoy
and as I have ever endeavour'd to Promote as much as in me
lay the true Interest of this Province as the most gratefull
return I cou'd make for the many marks of the Esteem they
had given me so I shall Constantly apply myself to do what-
ever is Proper for me in my Capacity that may be Conducive
to the publick Welfare of Maryland And therefore earnestly
recomend to you that you will on your parts Preserve that
Union which my Lords Propry & Guilford have so much at
heart for the Comon good.

Gentlemen of the Uper & Lower Houses
I am Comanded by the Lord Guilford on the Behalf of
the Lord Propry to deliver you his Lordship's most obliging
Answer to your Address dated the 10th of October last, this
being the first time of the meeting of the Assembly since I reed
it. By this Answer you will find his Lordship had the Good-

ness to promise you that noe Pson shoud be advanced to any
preferrmts that woud not qualify themselves by Law. And I
can now acquaint you that It is their Lordships Pleasure actu-
ally to remove them.

These unqualifyed psons obtaining Offices in the manner
they did that is in truth by Surprise & misinformation as it
