with their representation and her Majesty's Order for disal-
lowing the Several Acts of Assembly made in November
1709 for the Reasons in the said Representations Sett forth
Upon receipt whereof We need not now to tell you that
Proclamations have issued for repealing the afd Laws but must
observe to you their Lordships kind Intimation that if any of
the sd Laws be of absolute necessity for the good Governmt &
Welfare of the Province they may be reenacted as in their
Lordships' Letter pursuant to her Majestys late Instruction
transmitted us is prescribed
And forasmuch as we are truly Sensible Several of those
Acts are absolutely necessary for the good Governmt and
Welfare of the Province & especially those for regulating the
Militia and Limitting Officers Fees We must recommend them
to your Consideration to be reenacted not doubting but that
the Advantages thereby as well as the Dangers & Incon-
veniencys for want thereof are obvious to us all

Mr West and Mr Vanderheyden from the House of Dele-
gates present Mr Henry Ward a Delegate lately Elected for
Cecil County to be Sworn. Which was done at the Board and
the said Mr Ward Subscribed the Test and Oath of Abju-
ration.
The Rt Honble the Earl of Dartmouth's Letter of the 28th
of June 1711 with her Majestys additional Instructions to the
Commander in chief of this Province for the Time being dated
at Kensington the a6th June 1711 in the tenth year of her
Majestys Reign & under her Sign manual & privy Seale
being read at the Board
Advised and Resolved that the following Message be sent
to the House of Delegates Viz.

By the Honble President & Council in Assembly
October the 24th 1711

The honble Presidt having received her Sacred Majestys
royal Commands by way of Instructions to recommend to you
the Conforming our Gauge of Tobo Hhds with those of our
neighbours in Virginia and the passing a Law for that Pur-
pose with permission likewise to make an Act to prevent the
cropping of Tobo Hhds with a penalty therein not exceeding
what shall be imposed on such who Exceed the Gauge of
them
