562 Proceedings of the Council of Maryland, 1752.

Whereas by the Charter granted by his late Majesty King
Charles the first to Cecil Lord Baltimore bearing date at
Westminster the twentieth day of June in the eighth year of the
said Kings Reign, the Province of Maryland in America is
given and Granted to the said Lord Baltimore and to his Heirs
and Assigns, with Power, by and with the Consent and Advice
of the Freemen of the said Province or the Major part of
them, to make, constitute and ordain Laws and Ordinances
for the good Government of the same; Provided the said
Laws and Ordinances be not contrary and repugnant but as
near as may be agreeable to the Laws of this Kingdom of
England: And Whereas Appeals are frequently brought
before his Majesty in his Privy Council from the Judgments
and Decrees made in the Several Courts of Judicature within
the said Province of Maryland, the Determination whereof
depends upon being duly informed of the Laws Subsisting within
the Same it is therefore his Majestys Will and Pleasure, and
you are hereby directed and required to Cause a True &
Authentick Copy to be made of all the Laws and Ordinances
now in force within the said Province of Maryland, and to
Transmit the same duly authenticated under the publick Seal
of the said Province to the Commissioners for Trade and
Plantations, as soon as conveniently may be, in order to be
laid before his Majesty in his Privy Council.

His Honour the President acquainting this Board that he
had procured a Printed Body of the Laws, the following
Order was made

His Majesty in Council having directed all the Laws now
in force in this Province to be transmitted to the Rt honble
the Lords Commrs for Trade and Plantations in Order to be
laid by them before his Majesty in Council It is Ordered that

the Attorney General make marginal Notes against the several
Acts of Assembly now in print of such as are repealed dis-
sented to or expired by writing the Proper Words in the
Margin against such Law.

His Honour the President having laid before this Board
the Proceedings under the Commission of Oyer and Terminer
and Goal Delivery lately issued to Cecil County, whereby It
appears that the Commrs had passed Sentence of Death on a
certain John Batter for Felony and Burglary and that He was
a notorious Offender; It is the Advice of this Board that
Dead Warrant should issue for his Execution on Friday the
28th Instant
