cution is so awarded to be limitted & taxed by the Justices of
the said Court any Custom or Usage to the Contrary not-
withstanding.
Provided always that if any person dwelling in one County
be sued in another in such Cases a Scire facias shall be sued
as formerly This Act to endure for three years or to the end
of the next Session of Assembly which shall happen after three
years and no longer

An Act for laying an Imposition for three pence per hogs-
head on Tobacco for defraying the Publiq Charge of the
Province

Be it enacted by the King most excellent Majesty by and
with the Advice and Consent of this present Generall Assem-
bly and the Authority of the same That from and after the
tenth day of October next a Duty or Imposition of three pence
for every Hogshead of Tobacco and the like duty of three
pence for every four hundred pounds of tobacco contain'd in
Chest box or Case on all Tobacco that shall be exported Out
of this Province by land or Water be raised leavyed & payd
to his Majesty by all Masters of Shipps or other Vessells
trading into this Province in ready mony or bills of Exchange
at the Election of such Masters of Shipps or Vessells and to
be Collected by the Na vail Officer of the Port or District where
such Shipps and Vessells shall Clear and the said Officer shall
Account for the said Imposition of three pence p hogshead
and the three pence for every hundred pounds of tobacco con-
tain'd as above after the same Manner as for the Imposition
on Negros &c Sayd by a former Act of Assembly of this province.

And be it further Enacted by the Authority aforesaid by and
with the Advice and Consent aforesaid that the said Imposi-
tion of three pence p hogshead and three pence for every four
hundred pounds of tobacco Contain'd as afd shall be appro-
priated by the Generall Assembly of this Province towards the
paying of the publiq Charge thereof & to no other use what-
soever
And be it further Enacted and declared by the Authority
aforesaid by and with the Advice and Consent aforesaid that
if any tobacco should by any Casuall means be lost after the
Imposition payd that then in all such Cases the Owner or
ffreighter of all such Tobacco shall have free liberty ffreight
and Shipp on the like Quantity again without paying the said
Imposition. This Act to endure for two years and to the end
of the next Sessions of Assembly after the end of the said two
years
