76 Proceedings of the Council of Maryland, 1675-1676.
Lib. R. R. appoint & establish any judges or justices Magistrates &
Officers whatsoever at sea & Land for what causes soever
and with what power soever and in such forme as to his late
Lopp of noble memory as his heirs shall seeme most convenient
Also to remitt release pardon & abolish whether before judg-
ment or after all Crimes or Offences whatsoever against the
said Lawes and to doe all & every other thing or things which
unto the compleate establishment of justice unto Courts Pre-
tories & Tribunalls formes of judicature & manners of pro-
ceeding doe belong And by Judges by them delegated to
award processe hold pleas & determine in all the said Courts
& Tribunalls all actions suits & causes whatsoever as well
Criminall as civil personall, reall, mixt & pretoriall, which
being read & heard it is the judgment of his said Lordshipp
that they are legally authorized and impowered to act as
aforesaid according to the true intent of the said Charter.

At a Council held at St Johns the 12th day of April 1676

p. 60 Upon the Petition of Mr Christopher Rousby That Capt
Pery haveing a Considerable estate in this Province and being
by his Occasions called for England foure yeares agoe did
make Thomas Truman Esqr his Attorny But not receiveing
any effects of the produce of his said Estate he did about a
yeare since send in One Mr John Gould with power by a letter
of Attorny to manage the same who acted accordingly and have-
ing a great quantity of tobacco ready to Shipp for the accompt
of Capt Pery. It hath pleased God to take him the said Gould
out of this World so that for want of a person authorized to
Shipp it the said tobacco is like to lye in the Country. That
it was the instruction of the said Capt Pery that when the said
Gold should have Occasion to leave the Country he should
make the said Christopher Rousby his Attorny as the said
Gould declared upon his death bedd and as by a certaine
writeing under his hand & Seale then done & published may
appeare But that being short and defective and no other
Authority extant from Capt Pery.
The said Christopher Rousby most humbly referrs the
matter to his Lopps Consideration and prayes that for the pre-
